Jessica Waterfield charged with involuntary manslaughter in vehicular death of Atlantic pedestrian Erika Bailey

A grand jury has indicted an Accomack County woman on charges including involuntary manslaughter in the vehicular death of Erika C. Bailey, who was walking on Nocks Landing Road in April when she was fatally injured. 

Jessica Greenley Waterfield, 36, of Atlantic, the driver of the Honda sport-utility vehicle that struck Bailey, also is charged with reckless driving and careless driving, according to a state police press release. 

The grand jury, composed of residents of Accomack and Northampton counties, returned the indictments on Friday, July 14. 

Waterfield turned herself in to state police officers on Monday, July 17.

Bailey, 26, her 6-year-old daughter, and her boyfriend, 39-year-old Duane Lee Turner, were walking on Nocks Landing Road toward Atlantic on April 12, 2023, when the vehicle Waterfield was driving hit them.

Turner and the child were hospitalized. Waterfield and her 3-year-old daughter, a passenger in her vehicle, were unhurt.

Neither speed nor alcohol were contributing factors in the crash, police said. 

The Virginia State Police reconstruction team conducted a through investigation and provided its findings to Spencer Morgan, the Accomack County Commonwealth’s Attorney, according to the state police press release. 

Bailey’s death prompted several protests in the wake of the crash by people who wanted Waterfield to charged in the crash.
